The purpose of the data processing is making contact, answering your inquiry, providing a quote and consultation regarding our services.
Legal basis: your consent (GDPR Article 6(1)(a)), which you give by ticking the checkbox when submitting the form, and the taking of steps prior to entering into a contract (GDPR Article 6(1)(b)).
We process the data provided until the purpose of the contact is achieved, but for no longer than 1 year from the inquiry, or until you withdraw your consent. In the event of entering into a contract, the relevant statutory (e.g. accounting) retention periods apply.

Sections 1–5 of this policy relate to the processing of data on the website and during contact, where 5PL ERP Solutions Kft. qualifies as the controller.
In the course of using the Monolith ERP service our role is different. With respect to the personal data uploaded to or generated in the system by our customers (subscribers) — in particular the data of the orderers and buyers of their webshops and marketplace channels, the delivery and billing data, as well as the recipients of the notification, order status and invoice e-mails sent on behalf of our customers — our customer is the controller and we act as the processor (Article 4(8) and Article 28 GDPR). We process such data solely on our customer's instructions, for the purpose of providing the service; we do not use it for our own purposes and do not transfer it to third parties.

The detailed terms of the processing — with the content required by Article 28(3) GDPR — are set out in Section 14 of the T&C, which qualifies as the data processing agreement (DPA) between the parties. In addition, we have published the full text of the Data Processing Agreement (DPA) — with the details of the processing, the sub-processor list and the technical and organisational measures (TOM) as annexes — and the Non-Disclosure Agreement (NDA) as standalone documents. At our customers' request we provide both in signed form as well: erp@5pl.hu.
If, as a data subject, you provided your data through the webshop or marketplace channel of a 5PL customer, you can primarily exercise your rights with that customer (the controller) — but feel free to write to us as well and we will forward your request.
In the course of providing the Monolith service, beyond personal data we may also gain access to our customers' business secrets: inventory and procurement data, supplier and wholesale terms, purchase and sales prices, pricing strategies, margin, turnover and financial data, buyer and partner lists, as well as the marketplace, webshop, courier, invoicing and banking accesses, passwords and API keys provided by our customers.
We treat this information as strictly confidential: we use it solely for the purpose of providing the service, to the extent necessary (on a "need-to-know" basis), through our designated employees bound by confidentiality. We do not disclose it to third parties and do not use it to obtain our own business advantage — neither to gain a competitive advantage for ourselves or another customer, nor to take over supplier or buyer relationships, nor to underpin our own pricing decisions, nor to sell market data.
Our confidentiality obligation survives the termination of the contract for as long as the information concerned qualifies as a business secret. The detailed terms are set out in Section 14.3 of the T&C, which qualifies as a confidentiality agreement between the parties; at our customers' request we also sign a separate NDA (erp@5pl.hu).
